Process
A current employee can not be hired as an independent contractor, but they can be hired as a consultant in a secondary position.
Criteria
- Independent contractor candidate is a current district employee
- Current employee is interested in picking up a secondary position with a grant or project
Steps
- Hiring manager enters an employee requisition in PeopleSoft
- Current/active employees, send Supplemental and Hourly Pay form directly to payroll

Why This Is Important
- It’s the law (see Fair Labor Standards Act, Statutes 176.021, Minn. Administrative Rule 5224.0340, Minn. Statutes 5224, IRC 3509)
- Misclassification can deny employees benefits and protections they are entitled to
- Ensures taxes are properly collected
